The Orion Companies (“Orion,” “the Company,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy describes our privacy practices and how we collect, use, and share your “Personal Information” in connection with the TrueNorth™ website, web platform, and mobile application, including orion-truenorth.com or any other URL where this Privacy Policy is posted (collectively, the “Site”), and our business relationships with customers, prospective customers, and other visitors (collectively, the “Services”). It also explains your choices regarding your Personal Information and how to contact us.

This Privacy Policy applies only to the TrueNorth™ website, web platform, and mobile application, and not to any other websites, applications, products, services, operations, or businesses of Orion or its affiliated companies, unless those services expressly link to or reference this Privacy Policy.

Orion specializes in the manufacture and custom blending of agricultural and industrial chemical products, including herbicides, aquatic conditioners, and fertilizers, for business customers. The Site includes account registration, mobile application, mapping, and order-related features intended for business use by adults.

By using our Services, you agree to let us collect and use your Personal Information as described in this Privacy Policy. Before you provide us with any Personal Information, please review this Privacy Policy in its entirety. If you do not agree with this Privacy Policy, please do not use the Site or submit Personal Information to us.

Personal Information We Collect

• Orion collects information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, to an individual or household (“Personal Information”). We also collect non-Personal Information that cannot be linked to a specific individual; if such information is later combined with information that identifies an individual, we treat the combination as Personal Information. We may also use aggregated or de-identified data, such as statistical data, for any purpose, as this data does not identify you.

  We collect the following categories of Personal Information about you:

  Identifiers such as your first and last name, business name, job title, email address, username and password, applicator license number, if applicable, and other online identifiers.

  Contact Information such as your business mailing address, email address, and telephone number.

  Professional Information such as your employer or business name, your position or title, and your business contact details.

  Commercial Information such as records of the products or services you have inquired about or purchased, order history, custom blend specifications, and your preferred delivery or facility location.

  Billing and Invoice Information such as billing contact details, purchase order numbers, and invoice or payment records. Orion does not process credit card or other payment transactions directly through the Site; where payment is required, it is handled through a separate invoicing process or a third-party payment provider.

  Geolocation Data such as precise GPS location collected through the mobile application when enabled or when you use location-based features, and the delivery or facility address associated with your account, order, or service request.

  Technical Information such as your IP address, browser type, device type, mobile device information, and operating system, collected automatically when you use the Site.

  Usage Data such as the pages you view, the date and time of your visit, and how you interact with the Site.

  How Long We Will Use Your Personal Information

  We retain Personal Information only as long as reasonably necessary to fulfill the purposes for which it was collected, including to satisfy legal, regulatory, tax, accounting, or reporting requirements, or to resolve disputes and enforce our agreements. We may retain information for a longer period if we believe there is a prospect of litigation or a pending complaint.

  Collection of Information by Third Parties

  We do not control or endorse third-party websites or applications that may be accessible through the Site. This Policy does not apply to information collected by those third parties. Before providing information to a third party, we encourage you to review that party’s own privacy policy.

  How We Collect Your Personal Information

  We collect Personal Information about you in two ways: (1) directly from you when you provide it, and (2) automatically when you use the Site.

  Information You Provide

  Online Account Registration: When you register for or use an Orion business account, we collect Identifiers, Contact Information, and Professional Information to create and manage your account and to provide you with product and order information. This may include your email address and, if applicable, your applicator license number.

  Product Inquiries and Custom Blend Requests: When you request product information, a quote, or a custom blend, we collect Identifiers, Contact Information, Professional Information, and details about your requested products or specifications (Commercial Information).

  Orders and Invoicing: When you place an order, we collect Identifiers, Contact Information, and Billing and Invoice Information necessary to process and fulfill your order, including the delivery location or facility location (Geolocation Data).

  Communications with Orion: When you contact us by phone, email, or through the Site, we collect Identifiers and any other Personal Information you choose to provide so that we can respond to your inquiry.

  Business Contacts: We collect the Professional Information you provide so that we may contact you regarding our products, services, and business opportunities.

  Information Automatically Collected

  When you access the Site, we automatically collect limited Technical Information and Usage Data, such as your IP address, browser type, device type, and the pages or features you visit, in order to operate, secure, and maintain the Site. When you use location-based features in the mobile application, we may collect precise GPS location information. Orion makes minimal use of cookies and similar tracking technologies; any cookies we use are generally limited to those necessary for the Site to function properly, such as maintaining your login session. We do not currently use the Site to serve targeted or behavioral advertising, and we do not knowingly sell or share Personal Information with third-party advertising networks. If this changes, we will update this Policy accordingly.

  How We Use Your Personal Information

  We use the Personal Information we collect to facilitate our business relationship with you, comply with our legal and financial obligations, and pursue our legitimate business interests, including to:

  • Create and manage your business account;
  • Respond to product inquiries, provide quotes, and fulfill custom blending requests;
  • Process, fulfill, and invoice your orders;
  • Communicate with you about products, services, order status, and account matters;
  • Provide customer support and respond to your questions;
  • Maintain the security, integrity, and proper functioning of the Site;
  • Comply with applicable laws, regulations, and industry requirements relating to the sale, shipment, application, and recordkeeping for our products and services, including herbicides, aquatic conditioners, and fertilizers;
  • Enforce our agreements and legal rights, including the collection of amounts owed;

  We do not sell your Personal Information. We may disclose your Personal Information to the following categories of third parties:

  Service Providers: companies that perform functions on our behalf, such as order fulfillment, shipping and logistics, invoicing and billing, IT and website hosting, cloud hosting, application development and support, mobile application support, mapping and location services, and customer support.

  Professional Advisors: attorneys, accountants, insurers, and other professional advisors, as needed.

  Legal and Safety: government authorities, regulators, or others, where required by law, subpoena, or court order, or where we believe disclosure is necessary to protect our rights, property, or safety, or that of others.

  Corporate Transactions: in connection with a merger, acquisition, reorganization, sale of assets, or similar transaction, Personal Information may be disclosed to the parties involved.

  We use contractual or other means to require that third parties who receive Personal Information from us keep it confidential and use it only for the purposes we authorize.

  How We Protect Your Personal Information

  We take reasonable administrative, technical, and physical measures to protect the Personal Information we collect. No system, however, can guarantee absolute security.   Storage of Your Information Outside the United States and Canada

  Orion operates in the United States and Canada, and your Personal Information may be stored and processed on servers located in either country or in other locations where Orion or its service providers maintain systems. By using the Site or providing Personal Information to us, you understand that your information may be transferred to, stored, and processed in a country other than your country of residence, including the United States.

  Children’s Privacy

  The Site and our Services are intended for business use by adults and are not directed to children. By using the Site, you represent that you are at least eighteen (18) years old. If we learn that we have collected Personal Information from someone under the age of eighteen (18), we will take steps to delete that information. If you believe a child has provided us with Personal Information, please contact us using the information in the “Contact Us” section below.
